Welcome to Arka Design Studio. By accessing or using our website, submitting a form, requesting a consultation, booking a service, or engaging Arka Design Studio for a project, you agree to the following Terms & Conditions.
 
1. Services

Arka Design Studio provides interior design, home staging, architectural drafting, furniture rental, and related design services.

Because each project has different requirements, services may be customized based on the client's property, needs, project scope, timeline, and budget.
 

Information and pricing displayed on this website are provided for general informational and transparency purposes only and do not constitute a final quote, proposal, or binding offer.
 

Final pricing, scope of work, availability, and project terms will be determined directly with Arka Design Studio and confirmed through an invoice, proposal, agreement, or other written communication.
 
2. Consultations and Deposits

Some services may require a consultation before a project can be booked.

Any deposit paid to reserve a consultation is non-refundable. By submitting payment for a consultation, the client acknowledges and agrees to this policy.

A consultation does not guarantee that Arka Design Studio will accept or enter into a contract for additional services.
 
3. Pricing and Invoicing

Prices displayed on the Arka Design Studio website are intended to provide transparency and give clients an understanding of our general pricing.

Website pricing may not reflect the final cost of a specific project. Additional services, project requirements, changes in scope, special requests, or other circumstances may affect the final price.
 

Clients will receive an invoice from Arka Design Studio with the applicable services and final amount due.

A service or project is not considered officially booked or confirmed until the required agreement, payment, deposit, or other booking requirements have been completed.
 
4. Home Staging Services

Home staging projects are customized according to the property and the client's needs.

Staging services may include furniture, accessories, artwork, delivery, setup, removal, and other services as outlined in the client's invoice or agreement.

Furniture and décor shown in website photographs, marketing materials, inspiration images, or examples may not be the exact items provided for a client's project.
 

Arka Design Studio may use recycled, reused, vintage, or pre-loved furniture and décor. As a result, furniture and accessories may vary in style, color, material, condition, and availability and may show reasonable signs of wear.
 

Staging inventory is subject to availability.
 
5. Staging Rescheduling

Staging projects may be rescheduled when necessary, subject to Arka Design Studio's availability.
 

Clients should provide as much advance notice as reasonably possible when requesting a change to a scheduled staging date.

Rescheduling does not automatically guarantee availability for the requested new date.
 

Any additional costs resulting from changes to the project, extended rental periods, special transportation requirements, or other circumstances may be communicated to the client before the additional service is provided.
 
6. Client Responsibilities

Clients are responsible for providing accurate information regarding their property, project requirements, timeline, access, and other information necessary for Arka Design Studio to perform the agreed-upon services.
 

For staging projects, clients are responsible for ensuring that Arka Design Studio has reasonable access to the property at the scheduled time and that the property is ready for staging as previously discussed.
 

Failure to provide access or necessary information may result in delays or the need to reschedule.
 
7. Design Services and Revisions

Interior design and drafting services are provided according to the scope of work agreed upon with the client.
 

Any revisions, additions, or services outside the agreed-upon scope may be subject to additional fees.
 

Where a project includes a specified number of revisions or review rounds, additional revisions may be billed separately.
 

Clients are responsible for reviewing and approving designs, drawings, measurements, selections, and other project materials provided by Arka Design Studio.
 
8. Measurements and Existing Conditions

While Arka Design Studio makes reasonable efforts to obtain accurate measurements and information, existing conditions, field measurements, construction conditions, and information provided by third parties may contain inaccuracies.
 

Clients and contractors are responsible for verifying dimensions, site conditions, code requirements, structural conditions, and other information as necessary before construction, fabrication, installation, or ordering materials.
 

Architectural drafting services provided by Arka Design Studio do not replace the services or professional responsibilities of licensed architects, engineers, contractors, surveyors, or other required professionals where applicable.
 
9. Right to Refuse or End Services

Arka Design Studio reserves the right to refuse service, decline a project, or terminate an existing client relationship or contract when permitted by applicable law.
 

This may include circumstances involving inappropriate, abusive, threatening, discriminatory, unsafe, or unreasonable behavior; failure to make required payments; repeated failure to comply with project requirements; or circumstances that make it impractical for ArKa Design Studio to continue providing services.
 

If a project is terminated, the client's financial obligations for services already provided, approved expenses, or other amounts owed under an applicable agreement remain due.
 

Any refunds or credits, if applicable, will be determined according to the applicable service agreement and these Terms & Conditions.
 
10. Payments

All payments must be made according to the payment terms provided on the applicable invoice or agreement.
 

Failure to make payment when due may result in delayed services, cancellation, suspension of work, or termination of the project.

Arka Design Studio reserves the right to require payment in full, a deposit, or other payment arrangements before beginning or continuing certain services.

11. Cancellation

Cancellation policies may vary depending on the service and will be communicated to the client before booking when applicable.
 

Non-refundable deposits, including consultation deposits, remain non-refundable unless otherwise required by applicable law.
 

Cancellation of a project does not eliminate payment obligations for services already performed, materials or expenses already incurred, or other amounts agreed upon by the client.
 
12. Furniture and Rental Items

Furniture and décor provided by Arka Design Studio remain the property of Arka Design Studio or the applicable owner unless otherwise agreed in writing.

Clients and property occupants are responsible for reasonable care of rented or staged items while they are at the property.
 

Clients may be responsible for costs associated with loss, theft, damage beyond normal wear and tear, or unauthorized movement or disposal of furniture, décor, or other rental items.
 

Specific rental terms may be provided separately for applicable furniture rental services.

13. Travel & Long-Distance Projects

Projects located outside Arka Design Studio's standard service area may be subject to additional travel, delivery, installation, and logistics fees. Fees are determined based on location, distance, furniture volume, property access, installation requirements, and other project-specific factors.
 

Long-distance and mountain projects may also be subject to a minimum project investment. Any applicable fees and minimums will be communicated to the client and included in the project quote before services are scheduled.

 
14. Photography and Marketing

Arka Design Studio may photograph completed projects for its portfolio, website, social media, advertising, and other marketing purposes unless otherwise agreed in writing with the client.
 

Arka Design Studio will make reasonable efforts to avoid displaying private or personally identifying information belonging to the client.

Clients may request that a specific project not be used for marketing purposes by communicating that request to Arka Design Studio.
 
15. Intellectual Property

Unless otherwise agreed in writing, design concepts, drawings, plans, renderings, graphics, photographs, written materials, and other creative work produced by Arka Design Studio remain the intellectual property of Arka Design Studio.
 

Payment for services does not automatically transfer ownership of intellectual property to the client.

Clients may use final project materials for the intended project for which they were created, but may not reproduce, resell, distribute, modify, or use Arka Design Studio's work for another project or commercial purpose without written permission.
 
16. Website Content

The content on this website, including text, photographs, graphics, logos, designs, and other materials, is provided for informational and promotional purposes.
 

Arka Design Studio makes reasonable efforts to keep website information accurate but does not guarantee that all information, pricing, availability, photographs, or descriptions will always be current or error-free.
 

Arka Design Studio reserves the right to update, modify, or remove website content at any time.
 
17. Third-Party Services and Links

The Arka Design Studio website may contain links to third-party websites, platforms, products, or services.

Arka Design Studio is not responsible for the content, availability, policies, or practices of third-party websites or services.
 
18. Limitation of Liability

To the fullest extent permitted by applicable law, Arka Design Studio will not be responsible for indirect, incidental, consequential, or unforeseeable losses arising from the use of our website or services.
 

Arka Design Studio is not responsible for delays or inability to perform services resulting from circumstances outside of our reasonable control, including property access issues, contractor delays, construction delays, weather, transportation issues, supplier availability, or other unforeseen circumstances.
 

Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
 
19. Changes to These Terms

Arka Design Studio reserves the right to update these Terms & Conditions from time to time.

The updated version will be posted on this website with the revised "Last Updated" date.

Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms & Conditions to the extent permitted by law.
 
20. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Colorado, without regard to conflict-of-law principles.
